When your legitimate rights and interests are infringed upon, you can choose to protect your rights through negotiation, mediation, complaint or reporting, arbitration or litigation. Make good use of these 'weapons' in your hands and let them safeguard your investment journey!
1. What are the main ways to safeguard investors' rights?
Answer: When investors' rights are infringed upon, the main ways to protect their rights are:
(1) Negotiation. This is the most direct, economical, and often efficient solution. Generally speaking, negotiation is the first step in resolving disputes. When investors and securities firms have disputes, they should first resolve them through negotiation. Both parties should seek a mutually acceptable solution based on the principles of mutual understanding and seeking truth from facts.
(2) Mediation. Mediation is a way for investors to submit disputed matters to relevant institutions and have them assist in reaching a settlement agreement. Mediation can be conducted under the supervision of securities regulatory agencies, securities industry associations, stock exchanges, or mediators recognized by both parties. After mediation and reaching an agreement on relevant issues, a mediation record or mediation agreement can be made, which shall be signed and stamped by the parties and the mediator.
(3) Complaint. If you believe that your legitimate rights and interests have been violated, you can file a complaint with the relevant authorities and request a resolution. You can file a complaint with the China Securities Regulatory Commission (hereinafter referred to as "CSRC") or its dispatched agencies. The stock exchange also has the responsibility of regulating its members and listed companies. Both the Shenzhen Stock Exchange and the Shanghai Stock Exchange have dedicated departments to receive complaints from securities investors.
(4) Report. The China Securities Regulatory Commission has established a Securities and Futures Illegal and Irregular Behavior Reporting Center, responsible for accepting, reviewing, submitting investigations, and rewarding reports. If the informant reports to the various securities regulatory bureaus of the China Securities Regulatory Commission, the securities regulatory bureau is responsible for accepting, reviewing, investigating and other work related to the report. The whistleblower can report the suspected violation of securities and futures laws and administrative regulations by real name or anonymously to the CSRC and all securities regulatory bureaus through the reporting column, reporting telephone, letter, visit and other means on the CSRC's Internet website.
(5) Arbitration. Arbitration refers to a way of resolving disputes in which both parties reach an agreement before or after the dispute arises, voluntarily submitting the dispute to a third party (arbitration institution) for arbitration, and both parties have an obligation to voluntarily fulfill their obligations. Arbitration adopts a final and binding system, and the arbitration award has legal enforceability against the parties. If the parties fail to comply, they may apply to the court for compulsory enforcement.
(6) Lawsuit. Lawsuit, commonly known as "filing a lawsuit", refers to seeking judicial relief by filing a lawsuit with a court of competent jurisdiction. The litigation judgment has authority and enforceability, and the parties must comply with it.
